Legal Policies
This page contains all of SkillWave's legal policies in one place: Terms & Conditions, Privacy Policy, Cookie Policy, Disclaimer, Refund & Cancellation Policy, and Acceptable Use Policy. By registering, purchasing a plan, or using any part of SkillWave, you agree to the policies below.
1. Terms & Conditions
By registering, purchasing a plan, or using any part of SkillWave, you agree to these Terms. If you do not agree, do not use the platform.
1.1 Acceptance of Terms
These Terms & Conditions ("Terms") are a binding agreement between you ("User," "Student," "Teacher," "Principal," "Member") and [COMPANY LEGAL NAME] ("SkillWave," "we," "us"), operating at skillwave.es. We may update these Terms at any time; continued use after a change constitutes acceptance. Material changes affecting referral commissions or withdrawal terms will be notified at least 30 days in advance.
1.2 Eligibility
- You must be at least 18 years old to register or use SkillWave in any role.
- You must provide accurate, complete registration information. Providing false information may result in account suspension.
- Each individual may hold only one Student account. Duplicate accounts created to manipulate referrals or plan access are prohibited.
- Teacher and Principal accounts are subject to admin/institutional review and approval before activation.
- SkillWave reserves the right to refuse, suspend, or terminate any registration at its discretion.
1.3 Account Registration & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. SkillWave staff will never ask for your password. Notify us immediately at support@skillwave.es if you suspect unauthorized access. We are not liable for losses arising from your failure to safeguard your credentials.
1.4 Subscription Plans & Course Access
- Access to paid courses requires an active subscription plan. Plans are tiered; higher tiers unlock more course content.
- Prices are shown in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
- Plans are valid for the period stated at purchase and expire automatically without auto-renewal — there is nothing to actively cancel.
- Plans and course access are non-transferable between accounts.
- You are granted a limited, non-exclusive, revocable license to stream course content for personal, non-commercial learning during your active subscription. Downloading, screen-recording, redistributing, or reselling course content is prohibited.
- SkillWave may add, modify, or discontinue courses or plans, and will make reasonable efforts to notify active subscribers before removing content they currently have access to.
1.5 Payments
- All payments are processed through Razorpay, a PCI-DSS-compliant, RBI-regulated payment gateway. We do not store your card, CVV, or net-banking credentials.
- Your plan activates once payment is confirmed by Razorpay and verified on our server.
- If your bank account is debited but SkillWave does not receive payment confirmation, the amount is auto-refunded by Razorpay, typically within 5–7 business days.
1.6 Refunds & Cancellations
SkillWave allows a limited-time refund request after purchase, and purchases become final once that window closes. Full details — including the exact time window, refund percentage, and process — are in our Refund & Cancellation Policy, which forms part of these Terms.
1.7 Referral Program
- SkillWave operates a multi-level referral program (up to 3 levels for Student-to-Student referrals) and a separate Teacher/Principal referral structure. Current commission rates are shown live on your dashboard and in the Admin-configured settings; they are not fixed for the life of your account and may change with advance notice.
- Referral commissions are calculated as a percentage of the referred person's plan payment and are held in a pending state during the purchase's refund window (see Section 1.6) before being released to your wallet. If that purchase is refunded or cancelled, the associated commission is cancelled.
- The referral program is a supplementary earning opportunity attached to the sale of a genuine digital learning subscription — it is not an investment product, and participation is not required to access the courses you have paid for.
- SkillWave is not a money-circulation scheme, chit fund, or pyramid scheme. Fake accounts, self-referrals, or artificially inflated referral activity are prohibited and will result in forfeiture of the related commission and possible account suspension.
- Full commission rules, examples, and fraud-prevention terms are in our Referral Program Terms (linked from your dashboard).
1.8 Wallet & Withdrawals
- Commissions and earnings credited to your wallet may be withdrawn to your bank account or UPI ID, subject to the minimum and maximum withdrawal limits shown in your dashboard (these are configurable by SkillWave and may change).
- A processing fee currently set at 5% applies to every withdrawal request; the fee percentage is displayed to you before you confirm a withdrawal.
- Withdrawal requests require email OTP verification and are subject to a cooldown period (currently 7 days) between successive approved withdrawals.
- You are solely responsible for the accuracy of the bank/UPI details you provide. SkillWave is not liable for funds sent to an incorrect account due to details you entered.
- Withdrawals may be rejected for incorrect payout details, active fraud review, or amounts exceeding your verified wallet balance; rejected amounts are restored to your wallet.
1.9 Teacher & Principal Obligations
- Teachers must provide original, accurate course content free of plagiarism or infringing material, and are independent contributors, not employees of SkillWave.
- Principals are responsible for the accuracy of institutional information provided and for any budget they choose to allocate to advertising campaigns (Section 1.11).
- SkillWave may remove any course or suspend any Teacher/Principal account that violates these Terms or applicable law.
1.10 Prohibited Activities
You agree not to: use the platform for any unlawful or fraudulent purpose; create fake or duplicate accounts; manipulate the referral or commission system; harass, abuse, or threaten other users or staff; attempt to hack, scrape, or reverse-engineer the platform; upload malicious code; misrepresent your identity or affiliation with SkillWave; or send unsolicited bulk promotion of your referral link.
1.11 Principal Advertising Tools
Principals may optionally fund and launch YouTube/Google Ads campaigns for their institution through our Google Ads API integration. Campaign budgets are set and paid for by the Principal. SkillWave facilitates campaign setup and reporting but does not control, and is not responsible for, Google's approval, delivery, pricing, or performance of any campaign. All campaigns remain subject to Google's own advertising policies.
1.12 Intellectual Property
The SkillWave name, logo, platform design, and software are the property of [COMPANY LEGAL NAME]. Course content belongs to SkillWave or the contributing Teacher and is licensed to you for personal learning only, as described in Section 1.4. Any content you submit (profile information, support messages) remains yours, but you grant SkillWave a license to use it to operate the platform.
1.13 Account Suspension & Termination
We may suspend or terminate any account that violates these Terms. Where termination is due to a violation, unused plan access is forfeited and any wallet balance directly tied to fraudulent activity may be withheld pending investigation; legitimately earned balances above the minimum withdrawal threshold will otherwise be reviewed and paid out on request. You may request voluntary account deletion at any time by contacting support@skillwave.es.
1.14 Disclaimers & Limitation of Liability
SkillWave is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability to you for any claim will not exceed the amount you paid for your current active subscription plan. See our full Disclaimer for details on income representations, third-party links, and platform availability.
1.15 Indemnification
You agree to indemnify and hold SkillWave, its officers, and staff harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, misuse of the referral program, or infringement of a third party's rights.
1.16 Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute will first be raised with our support team at support@skillwave.es for informal resolution. If unresolved, disputes are subject to the exclusive jurisdiction of the courts of [CITY], [STATE], India.

2. Privacy Policy
This policy applies to skillwave.es and all Student, Teacher, and Principal portals operated by [COMPANY LEGAL NAME] ("SkillWave", "we", "us").
2.1 Who We Are
SkillWave is an e-learning platform providing course content, subscription plans, and a referral-based earnings program to Students, Teachers, and Principals (institutional partners), operated by [COMPANY LEGAL NAME], registered in India ("Company"). For any privacy question, contact us at support@skillwave.es.
2.2 Information We Collect
A. Account & Registration Data
- Students: full name, email, 10-digit Indian mobile number, password (bcrypt-hashed), state, city, optional profile photo.
- Teachers: full name, email, phone, subject specialization, experience, bio, and college/institution association (subject to admin approval before activation).
- Principals: institutional details and a college verification code used to validate your association with your institution.
B. Payout & Financial Data
If you request a withdrawal, we collect bank account holder name, account number, IFSC code, or UPI ID, solely to process your payout. We do not collect or store your card number, CVV, or net-banking credentials — those are entered directly on Razorpay's secure, PCI-DSS-compliant payment page and never pass through our servers.
C. Platform Activity Data
- Referral code, referral chain (who referred you / whom you referred), and referral role labels shown on your dashboard.
- Subscription plan history, course access, and lesson progress.
- Wallet ledger: credits, debits, commission entries, and withdrawal requests/status.
- Notifications, and (for Principals) YouTube/Google Ads campaign requests, budgets, and performance metrics if you use that feature.
D. Technical Data
- IP address, browser/device type, and standard server access logs.
- Session identifier (PHP session cookie) used to keep you logged in.
- A short-lived referral-attribution cookie (
ref_code) if you arrived via a referral link — see our Cookie Policy. - Font requests sent to Google Fonts servers when pages load (typography only — see Cookie Policy).
2.3 How We Use Your Information
- Account & access management — creating, verifying, and securing your account, and granting access to the courses your plan entitles you to.
- Payments — forwarding transaction details to Razorpay to process your purchase; verifying payment signatures before activating your plan.
- Referral & commission tracking — attributing referrals, calculating commission splits between Students, Teachers, Principals, and the platform, and crediting your wallet once a purchase clears its refund window.
- Withdrawals — verifying your identity via one-time password (OTP) email confirmation and transferring approved amounts to your bank account or UPI ID.
- Communication — verification emails, password resets, withdrawal OTPs, wallet/commission notifications, and support responses. We do not send unsolicited marketing email.
- Security & fraud prevention — detecting duplicate accounts, referral abuse, and payment fraud.
- Principal advertising tools — if a Principal chooses to fund a YouTube/Google Ads campaign for their institution, campaign and budget data is used solely to create and report on that campaign via the Google Ads API.
2.4 Legal Basis & Your Rights (DPDP Act, 2023)
We process your personal data on the basis of your consent (given at registration and at each payment/withdrawal step) and, where applicable, to perform our contract with you or to comply with Indian tax and financial recordkeeping law. Under India's Digital Personal Data Protection Act, 2023, you have the right to:
- Access a summary of the personal data we hold about you.
- Correct or update inaccurate or incomplete data via your Profile page.
- Withdraw consent and request erasure of your account, subject to Section 2.6 below.
- Nominate another individual to exercise these rights on your behalf in the event of death or incapacity.
- Lodge a grievance with our Grievance Officer (Section 2.8) and, thereafter, with the Data Protection Board of India.
To exercise any of these rights, email support@skillwave.es with the subject "Privacy Request."
2.5 Who We Share Data With
We do not sell your personal data. We share it only with:
- Razorpay — to process payments and (where applicable) refunds. Governed by Razorpay's own privacy policy.
- Our email provider (SMTP via Hostinger) — to deliver verification, OTP, and transactional emails.
- Google Ads API — only for Principals who actively create a YouTube/Google Ads campaign; only the campaign, budget, and reporting data needed to run that campaign is shared with Google.
- Google Fonts — a font-loading request only; no account data is sent.
- Legal authorities — where required by law, court order, or a lawful government request.
- A successor entity — in the event of a merger, acquisition, or sale of business assets, subject to the same protections described here.
SkillWave does not currently run third-party display advertising (e.g. Google AdSense) on the platform. If that changes in the future, this Privacy Policy and our Cookie Policy will be updated in advance and, where required, we will request your consent before any such cookies are set.
2.6 Data Retention
| Data | Retention |
|---|---|
| Account & profile data | While your account is active, plus a limited period after deletion to resolve disputes |
| Payment, wallet, commission & withdrawal records | As required under applicable Indian tax and financial recordkeeping law |
| Session data | Cleared after a period of inactivity (currently up to 1 hour) |
| Referral attribution cookie | Up to 30 days |
When you request account deletion, we deactivate and anonymize your profile. Financial and commission records tied to your account may be retained in anonymized or archived form where the law requires it, even after your account is deleted.
2.7 Data Security
- Passwords are hashed (never stored in plain text).
- Forms are protected against cross-site request forgery (CSRF).
- Card and net-banking details are never handled or stored by our servers — Razorpay processes them directly.
- Access to configuration, database credentials, and financial payout fields is restricted to authorized admin accounts.
No online platform can guarantee absolute security. If you become aware of unauthorized access to your account, contact us immediately at support@skillwave.es.
2.8 Grievance Officer
In accordance with the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, our Grievance Officer can be reached at:
Name: [GRIEVANCE OFFICER NAME]
Email: [GRIEVANCE OFFICER EMAIL]
Address: [REGISTERED ADDRESS], India
Response time: acknowledgment within 24 hours; resolution within 15 days.
2.9 Children's Privacy
SkillWave is intended for users aged 18 and above. We do not knowingly collect data from anyone under 18. If we learn that a minor has registered an account, we will suspend the account and delete the associated personal data.
2.10 Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be notified via email or an in-app notice. Continued use of SkillWave after an update constitutes acceptance of the revised policy.
3. Cookie Policy
3.1 What Are Cookies?
Cookies are small text files stored on your device that let a website remember information between requests, such as keeping you logged in.
3.2 Cookies We Use
Essential — Session Cookie
PHPSESSID keeps you logged in while you use SkillWave. It is required for the platform to function — without it, you cannot access your account, wallet, or courses. It expires when your browser session ends or after a period of inactivity (currently up to 1 hour).
Essential — Referral Attribution Cookie
ref_code stores the referral code from a link you clicked (e.g. ?ref=ABC123) so that if you register a few days later, the right person is credited as your referrer. It lasts up to 30 days, is HttpOnly (not readable by page scripts), and is only set after the referral code is validated against a real account.
Third-Party — Google Fonts
Pages on SkillWave load typography from fonts.googleapis.com. This causes your browser to make a request to Google's servers for font files, which may result in Google logging your IP address as part of normal web request handling. This is used only for displaying text correctly — SkillWave does not use this data for tracking or advertising.
SkillWave does not currently use Google AdSense, Google Analytics, or any other advertising/analytics cookies. If we introduce such tools in the future, this page will be updated first, and where legally required, we will ask for your consent before those cookies are set.
3.3 Controlling Cookies
- You can clear or block cookies through your browser's privacy settings at any time.
- Blocking the session cookie will prevent you from staying logged in.
- Blocking the referral cookie only affects referral attribution for future sign-ups — it does not affect your ability to use the platform.
4. Disclaimer
4.1 Platform Provided "As Is"
SkillWave, including its courses, dashboards, and any AI-assisted or automated features, is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be uninterrupted, error-free, or entirely free of bugs or security vulnerabilities, though we take reasonable steps to maintain and secure it.
4.2 No Guarantee of Referral Income
SkillWave's referral program lets you earn commissions when people you refer purchase a plan. We do not promise or guarantee that you will earn any specific amount, or any income at all. Your earnings depend on factors outside our control, including how many people you refer, the plans they buy, and current admin-configured commission rates, which may change with notice.
Any earnings examples shown in the app, on your dashboard, or in promotional material are illustrative only and do not represent typical results. Most participants earn modest or no referral income; only sustained, genuine promotion tends to generate meaningful commissions.
4.3 Not Financial, Tax, or Legal Advice
Nothing on SkillWave — including course content, dashboards, or support responses — constitutes financial, investment, tax, or legal advice. You are solely responsible for declaring and paying any tax due on income earned through the platform. Consult a qualified professional for advice specific to your situation.
4.4 Not a Money-Circulation Scheme
SkillWave sells genuine digital learning subscriptions; the referral program is a supplementary earning feature attached to real course sales, not a standalone investment or recruitment scheme. You are never required to recruit others to access the courses you have paid for.
4.5 Third-Party Links & Services
SkillWave integrates with, or links to, third-party services including Razorpay (payments) and the Google Ads API (for Principals running institutional ad campaigns). We are not responsible for the content, availability, decisions, or practices of these third parties, which are governed by their own terms and policies.
4.6 Principal-Funded Advertising
Where a Principal chooses to fund a YouTube/Google Ads campaign through our platform, SkillWave does not guarantee campaign approval, delivery, reach, or return on ad spend. All such campaigns remain subject to Google's advertising policies and review process, which SkillWave does not control.
4.7 Limitation of Liability
To the maximum extent permitted by law, SkillWave is not liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the platform. Our total liability for any claim will not exceed the amount you paid for your current active subscription plan.
5. Refund & Cancellation Policy
You may request a refund within 24 hours of purchase. If approved, 70% of the amount is refunded to you and 30% is retained as a processing fee. After 24 hours, purchases are final.
5.1 The 24-Hour Refund Window
Every plan purchase on SkillWave enters a 24-hour purchase-protection window starting from the moment of payment. During this window, you may submit a refund request from your Payment History page, stating your reason. This is the only period during which a refund can be requested; once it closes, the purchase is final and non-refundable except for the technical-failure cases in Section 5.5.
5.2 How Approved Refunds Are Calculated
If our team approves your refund request:
- 70% of your original payment is refunded to your original payment method via Razorpay.
- 30% is retained by SkillWave as a processing/administration fee.
- Your access to the plan and its course content is revoked once the refund is approved.
- Any referral commission generated by your purchase (to your referrer, their referrer, a linked Teacher, or a linked Principal) is cancelled and will not be paid out, since the underlying purchase no longer stands.
Refunds are reviewed and approved manually by our team; approval is not automatic. We may decline a refund request if we find evidence of abuse (e.g., repeated buy-and-refund cycles used to generate and cancel referral activity).
5.3 After the 24-Hour Window Closes
Once 24 hours have passed since purchase, your plan is treated as fully consumed digital access and the purchase becomes final. No refund will be issued for reasons including (but not limited to):
- Changing your mind after the window has closed.
- Not using the platform after purchase.
- Lower-than-expected referral earnings.
- Account suspension due to a Terms violation.
5.4 Plan Expiry — Nothing to Cancel
Plans do not auto-renew. Your subscription simply expires on the end date shown in your dashboard. There is no recurring charge to cancel — you choose whether to repurchase a plan when it expires.
5.5 Failed & Duplicate Payments
If your bank account is debited but SkillWave never receives payment confirmation, or you are charged twice for the same purchase due to a technical error, this is not subject to the 24-hour refund window described above — contact support@skillwave.es with your payment ID. Amounts that never reached us are typically auto-reversed by Razorpay within 5–7 business days; verified duplicate charges will be refunded in full.
5.6 Chargebacks & Bank Disputes
We ask that you contact our support team before filing a chargeback with your bank, so we can resolve the issue directly. This request does not limit your legal right to dispute a transaction with your bank or card network. Where a chargeback is filed, SkillWave will present transaction and delivery records to the payment gateway/bank to contest claims we believe are inaccurate.
5.7 How to Request a Refund
- Go to Payment History in your dashboard within 24 hours of the purchase.
- Submit a refund request with the reason for your request.
- Our team reviews the request; you'll be notified once it's approved or rejected.
- If approved, the 70% refund is initiated via Razorpay to your original payment method.
For help, email support@skillwave.es.
5.8 Digital Delivery — No Shipping
SkillWave is a 100% digital platform. We do not sell or ship any physical product, so no shipping or delivery policy applies. Access to purchased course content is granted electronically and immediately upon payment confirmation.
6. Acceptable Use Policy
6.1 Permitted Use
- Learning from courses included in your active plan.
- Sharing your referral link honestly with people who may genuinely be interested.
- Submitting withdrawal requests for commissions you have legitimately earned.
- Managing your profile, payout details, and account settings.
- Contacting support for genuine platform issues.
- (Principals) Creating and managing YouTube/Google Ads campaigns for your institution using your own budget.
6.2 Prohibited Activities
- Creating multiple or fake accounts, including to self-refer or inflate referral counts.
- Using bots, scripts, or automated tools to interact with the platform, or to register or refer accounts.
- Scraping, crawling, or harvesting data from SkillWave.
- Attempting to access another user's account, wallet, or private data.
- Uploading malicious code, viruses, or harmful files.
- Using the platform to conduct phishing, scamming, or any fraudulent scheme.
- Making false or exaggerated income claims when promoting your referral link.
- Mass-emailing, spamming, or adding people to groups without consent to promote your referral link.
- Using SkillWave's name, logo, or branding without written permission.
- Filing a payment chargeback without first attempting to resolve the issue with our support team.
6.3 Community Conduct
Treat every Student, Teacher, Principal, and staff member with respect. Discriminatory, hateful, abusive, or threatening language is not tolerated. Do not impersonate SkillWave staff or misrepresent your affiliation with the platform.
6.4 Enforcement
Violations of this policy may result in a warning, temporary suspension, permanent account termination, forfeiture of wallet balances directly tied to the violation, and — where warranted — legal action. See our Terms & Conditions for the full account suspension and termination process.
6.5 Reporting a Violation
If you encounter abuse, fraud, or a violation of this policy, report it to support@skillwave.es.
